These API Terms of Service ("Terms") govern access to and use of the OpenSnow and StormNet API ("API") by any individual or entity ("you" or "Customer"). By accessing or using the API, you agree to be bound by these Terms. If you do not agree, do not access or use the API.
1. Acceptance of Terms
This API Terms of Service document (the "API TOS") is an agreement you must accept in order to use the API (as described below). This document describes both your rights and your obligations as part of using the API. It is important that you read it carefully because you will be legally bound to these terms. Cloudnine Weather ("Cloudnine Weather" "OpenSnow" "StormNet" "we" "us") only provides the API to you subject to this API TOS. By accepting this API TOS or by accessing or using the API, you agree to be bound by this API TOS (including the Privacy Policy and general Terms of Use, which are incorporated here by reference).
If you are entering into this API TOS on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to this API TOS. In that case, the terms "you" or "your" shall also refer to such entity. If you do not have such authority, or if you do not agree with this API TOS, you may not use the API. You acknowledge that this API TOS is a contract between you and OpenSnow, even though it is electronic and is not physically signed by you and Cloudnine Weather, and it governs your use of the API.
2. API Key Definitions
Application – Any software application, website, or product you create or service you offer using the API (defined below).
API Documentation – The documentation, data, and information that OpenSnow provides regarding the use of the API.
Data – means any data made available by Cloudnine Weather and it’s API.
API or "our API" – The publicly available Application Programming Interface ("API") as well as the related API Documentation.
3. API Access & License
Subject to your compliance with these Terms, StormNet grants you a limited, non-exclusive, non-transferable, revocable license to access and use the API solely for your internal business purposes or permitted applications. You are responsible for:
(a) Maintaining the confidentiality of your API credentials.
(b) All activity that occurs through your account or API key.
(c) Promptly notifying us of any unauthorized use or security breach.
4. Prohibited Uses
You may not use the API to:
(d) Violate any applicable law or regulation.
(e) Reverse engineer, decompile, or disassemble any component of the API or StormNet services.
(f) Resell, sublicense, or redistribute raw API data without prior written consent from StormNet.
(g) Transmit harmful code, spam, or interfere with the integrity or performance of the API.
(h) Use the API as the sole basis for life-safety decisions, emergency dispatch, or any other purpose where API unavailability could directly result in personal injury or death.
5. Data & Weather Information
All weather data, forecasts, alerts, and related information delivered via the API ("Weather Data") are provided for informational purposes only. Weather forecasting is an inherently uncertain science. We make no representation that Weather Data is complete, accurate, current, or suitable for any particular purpose. You assume all risk associated with reliance on Weather Data.
6. Technical Support
We do not provide technical assistance or integration guidance of any kind in connection with the API. Documentation is made available on an "as-is" basis. We have no obligation to respond to support requests, bug reports, or feature requests. Customers are solely responsible for all integration and implementation efforts.
7. Data Storage & Privacy
You are responsible for how you store, handle, and use any data obtained through the API. We may collect and process certain usage and telemetry data in accordance with its Privacy Policy. By using the API you consent to such collection and processing.
8. Disclaimer of Warranties
THE API AND ALL WEATHER DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STORMNET EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
(i) Warranties of merchantability, fitness for a particular purpose, or non-infringement;
(j) Warranties that the API will be uninterrupted, error-free, or free of viruses or other harmful components;
(k) Warranties as to the accuracy, completeness, timeliness, or reliability of any Weather Data.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CLOUDNINE WEATHER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
(l) Indirect, incidental, special, consequential, or punitive damages;
(m) Loss of profits, revenue, data, business, or goodwill;
(n) Damages resulting from reliance on Weather Data for safety-critical or emergency purposes;
(o) Any other damages arising out of or related to your access to or use of (or inability to access or use) the API.
StormNet's total aggregate liability to you for all claims arising under or related to these Terms shall not exceed the amounts actually paid by you to StormNet in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain liability limitations; in such cases the limitation shall apply to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Cloudnine Weather and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) your use of the API; (b) your violation of these Terms; (c) your use of Weather Data in any application or service; or (d) any third-party claim relating to your application or use of the API.
11. Term & Termination
These Terms remain in effect while you use the API. We may terminate or suspend your access at any time, with or without cause, and without notice or liability. Upon termination you must cease all use of the API and destroy any cached data obtained through it.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles. Any disputes arising hereunder shall be resolved exclusively through binding arbitration or in the federal or state courts located within the United States, and you consent to the personal jurisdiction of such courts.
13. General Provisions
This API TOS and any documents incorporated into this API TOS by reference, constitute the entire agreement between you and Cloudnine Weather regarding the API and supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of this API TOS.
